If you've received notice of a claim or lawsuit, here's what to do next:
What to Do Now
- Notify us immediately. Log in to MyMagMutual and choose to Report a Claim under the Defending menu. You can also send to incidents@magmutual.com using this form. Be sure to complete all form fields, provide all relevant details and include any legal documentation.
Report an incident → - Preserve all records. Secure medical records, notes, phone logs, electronic communications, and legal documents. Do not alter or add to them.
- If you need support. You can reach an experienced risk consultant at 1-800-282-4882 from 8am–8pm ET, Monday through Friday. For urgent issues after hours, call our 24/7 hotline at 404-842-5454
What NOT to Do Now
- Do not contact their attorney or agree to make payments. All communication should go through your MagMutual claims representative.
- Do not discuss the case. Avoid conversations with colleagues, staff, or others.
- Do not create new documentation. Refrain from writing notes or internal summaries unless directed by counsel.
What to Know
- You’re not alone. MagMutual offers expert claims support for medical malpractice and other lines of coverage through dedicated claims professionals or defense specialists who guide you at every step.
- Be prepared for time away from practice. Your involvement will vary depending on the case, but litigation may require time for preparation, depositions, or trial.
- We have resources. Our Claims Process and FAQs explain what to expect and how we’ll support you throughout.
Take Care of Yourself
- This can be emotional. Being named in a claim or suit is difficult, even when you're confident in your care.
- Support is available. Ask us about our Peer2Peer Program program if you'd like to speak confidentially with another physician who’s been through the process.
- Take care of your well-being and your future. In addition to emotional support, make time to protect your financial well-being. Consider speaking with a financial planner or estate attorney to review your personal protections.
